'No retrieval of leaked tapes possible'


Government today turned down in the Supreme Court the plea of Tata Group Chief Ratan Tata's for steps to stop the publication in the media of the leaked transcripts of tapped conversations between him, his corporate lobbyist Niira Radia and others.

It also made clear that the income tax department cannot take action against any cell phone service provider who may have been responsible for "unauthorised supply of information".
It is for Telecom or any other competent ministry to look into it, the government said in an eight-page affidavit filed in the court.

"It is not possible or practical for the government to take steps to retrieve the various copies of some of the transcripts which have appeared in the print media or in the electronic media and which are being circulated on the internet," the affidavit said.

The affidavit was filed in response to the notice issued by the court on Dec two on a petition filed by Ratan Tata seeking a ban on further publication of the tapes in the media and action against those responsible for leaking them.

The government maintained that conversations were recorded as part of the surveillance ordered by the Directorate General of Income Tax (Investigation) following a complaint received by the Finance Minister on November 16, 2007 alleging that Radia had within a short span of nine years built up a business empire worth Rs 300 crore.

It was also alleged that she was an agent of foreign intelligence agencies and she was indulging in anti-national activities.

"Secrecy and security have been maintained and the integrity and safety of the data in electronic form have been ensured through proper checks in the systems through which the recordings have taken place," the Government said in the 8-page affidavit.

Mexico: La Familia cartel chief killed


The eccentric leader of the brutal La Familia drug cartel was killed in a shootout during two days of fighting between federal police and gunmen that terrified civilians across a western Mexican state, the government said Friday.

The death of Nazario Moreno Gonzalez — nicknamed "The Craziest One" — is a major blow to a drug cartel that rose to national prominence four years ago by rolling severed heads into a nightclub and declaring that its mission was to protect Michoacan state from rival gangs and petty criminals.

Police believed that the 40-year-old Moreno — also known as "El Chayo" or "The Doctor" — was killed in a clash Thursday between cartel gunmen and federal police, said Alejandro Poire, the government spokesman for security issues.

In a brief statement, the office of President Felipe Calderon confirmed Moreno's death.

Cartel gunmen have been fleeing with their casualties and Moreno's body has not been recovered, Poire said. Police recovered the bodies of three other suspected La Familia members and detained three others.

Five officers and three civilians — including an 8-month-old baby and a teenage girl — were also killed in the shootouts, which began Wednesday night, when La Familia gunmen attacked federal officers in Moreno's home city of Apatzingan and fired on cars.

The gunmen torched vehicles across Michoacan and used them as barricades, even blockading all entrances into its capital of Morelia to prevent federal police from sending reinforcements.

Moreno is considered the ideological leader of La Familia, setting a code of conduct for its members that prohibits using hard drugs or dealing them within Mexican territory. He purportedly has written a religiously tinted book of values for the cartel, sometimes known as "The Sayings of the Craziest One."

In February, the U.S. government added Moreno and six other reputed La Familia leaders to its "Kingpin Act" list, a move that prohibits American citizens and firms from having any business dealings with them and freezes any U.S. assets they may have.

Back in 2003, a federal grand jury in McAllen, Texas, indicted Moreno on charges that included conspiracy to distribute marijuana, cocaine and methamphetamine.

Bloody cost

Poire said Moreno emerged as the leader of La Familia in 2006, when the gang — then known as "The Business" — broke off from the Gulf cartel and declared its independence by rolling the severed heads into a disco in the mountain town of Uruapan.

A message left with the heads declared: "La Familia doesn't kill for money, doesn't kill women, doesn't kill innocents. Only those who deserve to die will die."

Calderon, who was born in Michoacan, responded by deploying tens of thousands of soldiers to the state to crush the cartel — an increasingly bloody fight that has since expanded to other drug trafficking hotspots across the country.

The crackdown has picked up pace over the past year: Moreno was the fourth top leader of a drug gang killed in shootouts with security forces since December 2009 and three other alleged cartel leaders have been arrested.

But the victories have had a bloody cost: 28,000 people have been killed in drug-gang violence since 2006.

La Familia has since become one of the biggest methamphetamine traffickers to the United States. Meanwhile, the cartel has proclaimed in banners and even newspaper advertisements that it is trying to protect Michoacan from other cartels and common criminals.

Cartel in decline?

A Mexican government profile said Moreno set out to kill top members of the Gulf cartel after breaking off from that gang, with the complicity of some state and federal law enforcement officials.

The government claims that that La Familia has been severely weakened after four years of fighting off its rivals and security forces.

Several leading La Familia traffickers have been arrested in recent months. One of those suspects, Sergio Moreno Godinez, said under police interrogation last month that the cartel is in decline.

He confirmed the authenticity of a letter, e-mailed to journalists and dropped on the streets of several towns, saying the cartel is willing to disband if the government can improve security for Michoacan.

"What we have seen in the last days is a criminal organization repudiated by the population, and which has been significantly weakened," Poire said. "This is demonstrated by its false calls for a truce and the confessions of its members."

Mexican authorities put a $2 million bounty on Moreno's head in March 2009. His official wanted poster — featuring a fuzzy photograph of a middle-aged man with a thin face and a mustachio — accuses him of drug trafficking, kidnapping and murder.

Poor people

In 2006, El Universal newspaper said it had interviewed two La Familia leaders, identifying one as "The Craziest One." He was quoted as saying: "There is a new policy: We are going to expose those who sell drugs, to those who steal, to those who kidnap, anybody who is out of line. This is the policy of The Business."

According to a U.S. Drug Enforcement Administration profile, La Familia members are believed to undergo a three-to six-month training camp in Michoacan.

"They believe they are doing God's work, and pass out Bibles and money to the poor," the profile says. "La Familia Michoacana also gives money to school and local officials."

The Mexican government profile said Moreno "erected himself as the 'Messiah', using the Bible to profess to poor people and obtain their loyalty."

In January 2009, authorities in Michoacan seized a car with 23 guns, four grenades — and nine copies of "Wild at Heart," a book written by American Christian author John Eldredge. The books had inscriptions signed by "The Craziest One."

La Familia leader

His wife, meanwhile, hosts self-improvement seminars in Michoacan, including one in April at a club in Apatzingan that was promoted with posters titled "Let's help create a better future," according to the Mexican government.

Mexican authorities believe La Familia operates "by means of an executive council" compromised of both drug traffickers and government officials, according to the DEA.

In 2009, the Calderon government arrested more than 30 Michoacan state and local officials — including 12 mayors — accused of protecting La Familia in a highly touted sweep meant to show no politicians are immune from prosecution. The cases have since unraveled for lack of evidence in one of the biggest setbacks of Calderon's drug war. Only one of the officials — a former mayor — remains in prison.

The other reputed La Familia leader is former school teacher Servando Gomez. He is described as the operational chief of the cartel in an October 2009 Justice Department indictment for conspiracy to import and distribute cocaine to the United States.

The indictment says Gomez is in charge of acquiring weapons for the cartel and may be behind the murder of 12 Mexican federal law enforcement officers whose bodies were found in July 2009 following the arrest of another La Familia leader.

Saina in Hong Kong Super Series final


Ace Indian shuttler Saina Nehwal fought her way to the Hong Kong Super Series final with a gruelling three-game victory over sixth seed Juliane Schenk of Germany in Wanchai today.

The second seeded Indian registered a 21-19 17-21 21-12 win over Juliane in a 53-minute women's singles semifinal match.

Twenty-year-old Saina will lock horns with third seed Shixian Wang of China in the summit clash tomorrow. Shixian beat top seed and compatriot Xin Wang 21-12 21-14 in another semifinal match.

In a battle of nerves, Saina was trailing 8-12 but the Indian won four straight points to first catch up with the German and then level 17-17 before marching ahead to pocket the first game.

But the Hyderabadi couldn't hold on to the lead in the second game and from 5-5, Juliane moved ahead in strides to bounce back into the match.

In the decider, Saina gave no chance to her rival and opened a 6-1 lead before surging ahead to 11-3 and 19-9 before wrapping up the match.

"The final will be a tough match because Shixian is in good form. It has been a fantastic year for Saina and will have to see how she plays tomorrow. She has been very consistent and have done well in bigger events and am happy overall," national coach and Saina's mentor Pullela Gopichand told PTI.

"She missed out of at least five super series this year because the Commonwealth Games and Asian Games were more important events but it also means that she missed out of some events which otherwise could have taken her to the number one spot. But it doesn't matter, what matters is number of wins," he added.

Saina registered three back-to-back titles this year, winning the Indian Open, Singapore Open and defending the Indonesian Open. But the icing of the cake for her was the Commonwealth Games gold medal.
In the Asian Games last month, Saina, however, lost in the quarterfinals to Pui Yin Yip of Hong Kong. However she didn't take time to take her revenge as the Indian beat Pui Yin Yip in straight game in the quarterfinal of the Hong Kong Open to reach the semifinals.

"It is good that she didn't take much time to recover from that loss," Gopichand said.

'BASIC nations happy with Cancun texts'


India today said that the BASIC countries were "very happy" with the two draft texts prepared by climate negotiators from almost 200 nations on the Kyoto Protocol and a long-term action to combat climate change.
Following the circulation of two texts, still remain to be adopted by the 193 countries in some formal manner, Environment Minister Jairam Ramesh said that the outcome was "acceptable" to India.
"We have a Cancun agreement," he said, noting that the BASIC countries were "very happy" with the text.
The BASIC countries (BASIC or G4) are a bloc of four large developing countries -- Brazil, South Africa, India and China -- formed by an agreement on 28 November 2009.
Over the past two weeks, there has been concern that the talks might fail since Japan and Russia have said that they will not commit to the second period of the Kyoto Protocol, which is the only treaty on climate change that puts legally binding cuts on developed countries.
In the last few days, negotiators have struggled to formulate text that accommodates the desire of the majority of developing countries to continue with the Kyoto Protocol, and also not to force Japan and Russia into a second commitment period.
The first commitment period, which expires at the end of 2012, requires industrialized countries to reduce their greenhouse gases by 5 per cent from 1990 levels.
Stricter scrutiny

The text currently calls for the parties to act so that "there is no gap between the first and second commitment periods."
Observers here have interpreted the text differently - some groups have said that it is a "weak" text that will eventually lead to the death of Kyoto Protocol, while others look at it workable "compromise" for the moment.
Observers also said that while the two texts may be considered a significant political step in  moving the negotiations forward, they were not really helpful in combating climate change and the compromises were not rooted in what the science demanded.
"It operationalized the Copenhagen Accord and considering the Copenhagen Accord pledges are not adequate this is disastrous for the environment," said Chandra Bhushan from the Centre of Science and Environment.
The reaction to the text of the long-term plan to combat climate change has also been mixed.
Ramesh said that many of India's contribution had been incorporated in the text including the International Consultation and Analysis, which is a transparency mechanism to review whether developing countries are carrying out their domestic mitigation actions.

Ramesh pointed out that under the current texts developed countries were subject to stricter scrutiny on their mitigation cuts than developing countries.
Emission goal

The minister also noted that there is no "peaking year" mentioned in the draft and there was no mention of global emission goal set for 2050.
"Cancun represents an important step forward," he said.

On the other hand, Bhushan pointed out that the lack of these two measures for developed countries spelled doom for the environment.
Discussion on the two texts in a meeting with all the countries is set to begin shortly and will extend late into the night.
Bolivia, however, criticized the draft as too weak and accused other nations of trying to isolate it at the UN climate change conference.

"This document doesn't take into account Bolivia's proposals," climate negotiator Pablo Solon said.

"Bolivia isn't ready to sign up to a document which means a rise in temperature which will put more humans in a near-death situation," Solon said, charging it could allow a rise of more than four degrees Celsius.

UN meeting OKs climate deal


A U.N. conference has approved a two-part climate deal that creates a Green Climate Fund and takes other small steps to deal with global warming.

Mexican Foreign Secretary Patricia Espinosa, the conference president, gaveled the decisions early Saturday over the objections of Bolivia, which said the deal didn't go far enough in curbing climate change.

Decisions at the U.N. climate talks are typically taken by consensus, but Espinosa says consensus doesn't "mean that one country has the right to veto" decisions supported by everyone else.

Amid allegations of flip-flops in allocation of 2G spectrum and corporate houses getting into bitter spat, India Inc today raised concerns that the controversies could dent investor confidence in the telecom sector.
The newly-elected President of industry body Assocham, Dilip Modi today said, "Uncertainty hurts industry... At the end of the day, when you hear about showcause notices and licence cancellations (of telecom operators), there is an uncertainty. It will definitely, reflect on investment."
For, these reasons investment climate could be negative, he said.
To what extent, such a murky war in the telecom industry would tarnish the credibility of the sector, Modi, who also leads telecom firm Spice Mobility said: "When any industry comes under scanner, all the stakeholders also come under the scanner...it does affect credibility."
Modi, who was one of the early mobile operators, added that the telecom industry should not be viewed in a negative light. "It doesn't deserve it."
He had exited the sector in 2008 by selling his stake in Spice Communication which merged with Idea Cellular.
Modi is assuming the role of Assocham President at a time when telecom, one of the success stories of the Indian economy, is going through uncertain times.
Moreover, top industry players are hurling allegations against each other.
A worried Modi said that investors need a stable policy environment.
When asked about telecom operators not sharing information with the government on 2G spectrum allocation in 2008, Modi made it clear that if there are rules and regulations laid by the government, the corporates should have followed them.
Modi, 36, who is the youngest President of the Chamber of Commerce, said that he has a lot to learn from his current job.
"This job will expose me to more opportunities, the country has to offer... It is going to be on-the-job learning for me," he said.

Controversy over Sonia's b'day celebration


The celebration of Sonia Gandhi's birthday by Congress party here has run into controversy with the BJP strongly protesting cutting of a tricolour-shaped cake on the occasion, alleging it was an insult to the national flag.
Local newspapers carried photographs of Chhattisgarh Congress party leader Subhash Sharma celebrating Sonia's birthday by cutting tricolour-shaped cake.
Taking objection to it, the state BJP unit today staged a protest rally and demanded the Congress leaders apologise for the "blunder".
BJP's state unit Vice President Sachhidanand Upasane alleged it was "an insult" to the national flag. The state Congress leaders were so much engrossed in praising Sonia that they forgot to show respect to the national flag, he charged.
Demanding action, the BJP leaders said that they would lodge a police complaint in this connection.
City chief of Congress Indarchand Dhadiwal, however, has rejected the allegation that it was a tricolour-shaped cake.
There were many colours given to the cake and there was no Ashoka pillar on it, he said.

Stand-in captain Gautam Gambhir praised off-spinner Ravichandran Ashwin's performance terming him the find of the one-day series.

"Ashwin for sure was most impressive. He is a quality bowler even as we saw in the IPL, the way he bowled in the Powerplays... If you have an off-spinner who can bowl well in the Powerplays and slog overs, it can be a great asset for the team," Gambhir told the reporters at the post-match press conference.

The skipper was happy as his teammates didn't show any complacency while whipping the Black Caps.

"I have always stressed that no one takes any match lightly when you are playing for your country. I think a lot of credit goes to young bunch as we didn't get complacent after clinching the series. That's what professionalism is all about and speaks a lot about your character."

Gambhir feels that it's positive sign that the fringe players cashed in on the opportunity which augurs well for the team.

"It's always a good sign when your reserve players do well. It's a good thing that there is a healthy competition and that can bring the best out of any player. You can never afford to be complacent at any stage because you know there is another one waiting in the wings."

However the opener admitted that World Cup will be an entirely different ball game altogether.

"I think World Cup will be a different ball game. There will be far more pressure and there will be a lot of expectations from us as well. If you really want to be number one and you really want to sustain at that position, you need to improve all the time.

"I think we need to improve our fielding. If we compare ourselves to New Zealanders, they were far more brilliant on the field. If we can improve as a fielding unit, we will be strong contenders for the Cup as we have a very potent batting and bowling line-up."

"He bowled brilliantly. I think Yuvraj was also brilliant. He delivered with whatever opportunities he got."

The skipper also praised Yusuf Pathan whose magnificent century got India home during the fourth one dayer in Bangalore.

"I think Yusuf played a fantastic innings. I have always felt that Yusuf is someone who has the talent to turn the game on its head. If you see the last game, he turned it completely. Given the situation not many would have given us a chance to win the match, but he won it for us."

About the Chepauk track, the southpaw said that this was the first turner they got in the entire series.

Jolie's night outs with Pitt in Venice


Hollywood actress Angelina Jolie often snuck out at night with husband Brad Pitt during her stay in Venice while filming The Tourist. The couple relocated to the Italian city with their six children while Jolie shot the film and the whole family loved the experience, reported Daily Record.

"We went to the museums and got our Sunday breakfasts at this great place we found. We all used to sneak out and go through the cobblestone streets or get on the boats and go to the park. "There's great places to play football and amazing restaurants in the middle of the night for mom and dad to sneak out in our big plastic boots and wade through the water," said Jolie.

The 35-year-old actress loved working with her 'Tourist' co-star Johnny Depp and was surprised by his multiple talents. "I think what surprised me was that he was as wonderful as I wished he would be. You just never know when you meet somebody and when I met him, he was even cooler and even more interesting," she said.

"He's a Renaissance Man, he can paint, he can do music, he's one of those wonderful artists," she added.

'Cuba to be insolvent within 2-3 years'


A newly released confidential U.S. diplomatic cable predicted Cuba's economic situation could become "fatal" within two to three years, and detailed concerns from other countries' diplomats — including China — that the communist-run country has been slow to adopt reforms.

The cable was written last February, months before Cuban President Raul Castro announced a major revamp of the island's economy, laying out plans to fire a half-million state workers and open up the island to expanded forms of private enterprise.

The cable, sent by the U.S. Interests Section in Havana, which Washington maintains instead of an embassy, was released Friday by WikiLeaks. It was apparently written by America's chief diplomat on the island, Jonathan Farrar.

Cuban parliament chief Ricardo Alarcon, who often speaks on U.S. issues, told The Associated Press the cable did not contain anything new or interesting. "It seems to me Jonathan Farrar was a little depressed that day" that he wrote the dispatch, Alarcon said.

Relations between Washington and Havana are already strained by the long detention of an American contractor on suspicion of spying — not to mention 50 years of Cold War animus, and the release of the cable was not likely to help matters.

It details a breakfast meeting held by the Interests Section's chief economic officer with diplomats from some of Cuba's main trading partners, including China, Spain, Canada, Brazil and Italy, as well as France and Japan, both of which are among the island's top creditors.

"All diplomats agreed that Cuba could survive this year without substantial policy changes, but the financial situation could become fatal within 2-3 years," the cable said, adding that Italian diplomats cited sources within the Cuban government as predicting that the island "would become insolvent as early as 2011."

Cuban request

Even the Chinese diplomat expressed what the cable referred to as "visible exasperation." It said the Chinese were particularly annoyed by Cuba's insistence on retaining majority control of any joint venture.

"No matter whether a foreign business invests $10 million or $100 million, the GOC's (Government of Cuba's) investment will always add up to 51%," the cable quoted the unidentified Chinese commercial counselor as saying.

The Chinese also complained about problems getting loans repaid, and in particular a Cuban request to extend from one year to four years the amount of time it has to repay credit.

It is no secret that Cuba's financial situation is increasingly dire. Raul Castro has warned that the state can no longer afford to subsidize nearly all forms of Cuban life. The government provides free health care and education, and nearly free transportation, housing and utilities. All Cubans also receive a ration book that provides them with some basic food, though not enough to live on.

Most islanders work for just $20 a month in a state-dominated economic system riddled with inefficiency.

Yet the country has survived the collapse of the Soviet Union, which caused the near-failure of its economy, as well as a 48-year U.S. trade embargo, the retirement of revolutionary leader Fidel Castro in 2006 and countless other bumps along the way.

Economic reforms

And the cable's confidence that the government would not enact economic reforms did not pan out. The reforms announced by Raul Castro in September are considered the most significant in a generation. Still, it is unclear if they will be enough to save the island's perennially weak economy.

The cable said Cuba's attempts at agricultural and other reform up to that point had been ineffective, and said more changes were unlikely. It said the country seemed determined to give the more control over state-run businesses to the military, and particularly Agriculture Minister Ulises Rosales del Toro, whom the cable described as Raul Castro's most trusted general.

The cable said the situation would worsen dramatically should there be economic or political problems involving Cuba's top ally, Venezuela, which the dispatch said was "increasingly unstable." It quoted the French diplomat at the meeting as saying Hugo Chavez's country "is in flames" and "a source of serious concern for Cuba."

Cuba receives billions of dollars worth of oil a year from Venezuela at greatly subsidized prices in exchange for the services of Cuban doctors and other help.

"There is little prospect of economic reform in 2010 despite an economic crisis that is expected to get even worse for Cuba in the next few years," the cable said, citing Cuba experts. It closed with a scathing criticism of the leadership of a government ruled by aging brothers Fidel and Raul Castro since they overthrew dictator Fulgencio Batista in 1959.

The government's "direction and leadership remains muddled and unclear, in great measure because its leaders are paralyzed by fear that reforms will loosen the tight grip on power that they have held for over 50 years," it said.

Thespian Dilip Kumar, popularly known as the 'tragedy king' of Indian cinema, turned 88 today and was honoured with the title "patron of alumnus" by his alma mater G N Khalsa College here. The legend has become one of the oldest living ex- students of the institute located in Central Mumbai, College Principal Ajit Singh told PTI.

"Dilipsaab is not keeping well. When we told him about our initiative to honour him, he was touched. He recalled several anecdotes about his student life and was overwhelmed," he said.

Another alumnus, former hockey player Mir Ranjan Negi, participated in a hockey match between ex-students and the present ones. "Dilipsaab is an avid hockey fan and we thought a hockey match would be a good way to pay respect to him," Singh said. The veteran actor, who retired from silver screen in 1998, is best remembered for his variety of roles in Andaz, Aan, Devdas, Azaad, Mughal-e-Azam, Ganga Jamuna and Naya Daur.

In 1976. Kumar had a five-year break from films. In 1981, he returned with a character role in Kranti and continued his career playing central character roles in movies such as Shakti (1982), Karma (1986) and Saudagar (1991) his last film was Qila in 1998. He was honoured with the Padma Bhushan in 1991 and the Dadasaheb Phalke Award in 1994.

Band Baajaa Baaraat box office collection Rs 80 lakhs


On the other hand, Yash Raj Films’ Band Baajaa Baaraat was a total non-starter at the box office. The movie starring newbie Ranveer Singh and Anushka Sharma took in net collections of only Rs 8 million (Rs 80 lakhs) on Friday.
